Not to be confused with Commercial Auctions advertised by some other websites and agencies, we are lucky enough to be able to offer Judicial Auctions, or Subastas in Spanish, through the Courts here on the Costa del Sol.

The legal process in Spain demands all properties that are undergoing the repossession process must be put through a Judicial Subasta.  These proceedings are held in the Court Room and are overseen by a Court Judge.  This is not a Commercial Auction designed to get the best price, but rather a legal process designed to recover the outstanding debt, for a plaintiff first, or the property will be repossessed and passed to that plaintiff.

It stands to reason then, that the best deals are taken through this process long before they ever appear as a repossession on a banks balance sheet.  Indeed currently there are circa 50 – 70 Judicial Subastas every week through the courts here on the Costa del Sol.  However probably 3 or 4 of these are of any commercial interest for serious investors or buyers  These are the opportunities that we are bringing to our clients and to the clients of other Agents along the Coast here.

These opportunities are not for all buyers we understand and some notable points to consider before pursuing this type of investment are; 

• These are Cash only deals – the Court will not wait for you to arrange a mortgage.
• The properties can only be viewed externally – until repossessed there is no legal right to enter the properties, they are in fact someone else’s property until proceedings have concluded.
• We are offering the properties for the lowest possible price we reasonably believe we can deliver them for.  These are bargain prices and any amount of due diligence from clients will show this.  We cannot therefore entertain lower ‘bids’ as this drastically reduces the chance of delivery, wasting opportunities for us and our clients. 

We cannot always guarantee which properties will be going through Subasta at any particular time.  So if you are looking for a particular property with a particular view for example this may not be the avenue for your property search.  However if you have an eye for a bargain, if you can see a deal and a way of making a good investment based on factual information in today’s market place and are not afraid to make a decision based on these facts, then the Juducial Subasta Properties we offer might just be for you…
